Arizona state Secretary Katie Hobbs, who was declared the winner of the governor’s race just days ago, has joined Maricopa County’s movement for sanctions against her opponent, Carrie Lake.
Maricopa County Superior Court Judge Peter Thompson ruled against Lake’s challenge to the result Gubernatorial race in November in which Hobbs was declared the winner by about half a percentage point.
Thompson, who was appointed by then-Gov. Jan Brewer, a Republican, found that the court was not presented with clear and convincing evidence of widespread wrongdoing that Lake allegedly influenced the results of the 2022 general election.
Lake’s allegations include problems with ballot printers at some polling stations on Election Day that were the result of intentional misconduct. Thompson said Lake’s witnesses claimed no knowledge of the alleged wrongdoing.
On Monday, Hobbs asked the court to award her $36,990 in attorney fees and costs for the litigation related to Lake’s challenge.
The secretary hired Coppersmith Brockelman PLC attorney Andrew Gaona, who has been with the firm for 12 years, to represent her during an expedited election process that “required extensive legal work in a very short period of time,” according to the filing.
The attorneys had to prepare a motion for recusal, prepare for an evidentiary hearing, and participate in the two-day evidentiary hearing.
“As a result of the efforts of counsel for the Secretary and the other defendants, the court denied to the plaintiff remarkable claim for relief in its entirety,” the court statement reads. “Accordingly, the Secretary has prevailed and achieved complete victory in this litigation.
“For the foregoing reasons, the Secretary respectfully requests that the court award her $36,990 in reasonable attorneys’ fees and ‘expenses’ incurred in this case,” the filing concludes.
When broken down, the fees consisted of 94.3 hours worked by CB, totaling $31,090, plus an additional $5,900 for services provided by expert witness Ryan Macias.
